Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

Application refers to CrewCam, the software program provided by the Company.

Company (referred to as either "the Company," "We," "Us," or "Our" in this Agreement) refers to CrewCam Inc.

Country refers to: United States.

Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.

  • Internet or Network Activity: browsing history on our Service, search history, interactions with our Service, advertisements, and emails.
  • Geolocation Data: approximate location derived from IP address; precise location from GPS when authorized for job site documentation.
  • Visual Information: photos, videos, and audio recordings you capture and upload through the Service.
  • Professional Information: company name, job role, trade specialty, project information.
  • Inferences: inferences drawn from the above to create a profile reflecting preferences, characteristics, and behavior for product improvement and marketing.

We do not knowingly collect "sensitive personal information" as defined under the California Consumer Privacy Act (CCPA/CPRA).

The Company allows you to create an account and log in through Third-Party Social Media Services including Google, Facebook, Instagram, Twitter, and LinkedIn. If you register through these services, we may collect Personal Data already associated with your Third-Party Social Media Service account, such as your name, email address, activities, or contact list.

Information Collected While Using the Application

While using our Application, in order to provide features of our Service, we may collect, with your prior permission:

  • Pictures, videos, and audio from your device's camera, microphone, and photo library
  • Precise location information for job site documentation
  • Voice recordings used to generate AI-powered reports

You can enable or disable access to this information at any time through your device settings.

Tracking Technologies, Cookies, and Advertising

We use Cookies and similar tracking technologies (including web beacons, pixels, tags, and scripts) to track activity on our Service, store certain information, analyze usage, and deliver advertising.

Advertising Partners and Meta Pixel

We use the Meta Pixel (also known as the Facebook Pixel) and related Meta business tools provided by Meta Platforms, Inc. on our Website. The Meta Pixel is a snippet of code that allows us to:

  • Measure the effectiveness of our advertising on Facebook and Instagram
  • Track conversions and actions taken on our Website (such as form submissions, sign-ups, and purchases)
  • Build custom audiences for advertising, including retargeting visitors who have previously interacted with our Service
  • Create "lookalike audiences" of people similar to our existing customers

When the Meta Pixel fires, the following information may be shared with Meta:

  • IP address
  • Browser and device information (user agent, screen size, operating system)
  • Referring URL and pages visited on our Website
  • Actions you take on our Website (button clicks, form submissions, conversions)
  • A Meta-assigned identifier (such as the _fbp cookie); if you are logged into Facebook or Instagram, Meta may also associate this activity with your Meta account
  • Standard and custom event data we configure

This information is processed by Meta in accordance with Meta's Data Policy, available at https://www.facebook.com/privacy/policy. We and Meta act as joint controllers for the collection and transmission of this data under applicable European law, pursuant to Meta's Controller Addendum (https://www.facebook.com/legal/controller_addendum).

How to opt out of Meta Pixel tracking:

  • Adjust your Instagram ad preferences in your Instagram account settings
  • Use the Digital Advertising Alliance opt-out at https://optout.aboutads.info

  • Enable "Do Not Track" or Global Privacy Control (GPC) signals in your browser; we honor GPC signals as a valid opt-out request from California residents

Sharing of Your Personal Data

We may share your personal information in the following situations:

With Service Providers: to monitor and analyze the use of our Service, deliver the Service, process payments, host data, and communicate with you. Our Service Providers include cloud infrastructure providers, payment processors, analytics providers (including Hotjar), email and messaging providers (including Loops and Intercom), AI and machine learning providers (including OpenAI), and customer relationship management providers (including Salesforce).

With Advertising Partners: including Meta Platforms, Inc., for the purposes described in the "Advertising Partners and Meta Pixel" section. Under California law, the transmission of personal information to advertising partners for cross-context behavioral advertising may be considered "sharing" or "selling" of personal information. See "Your California Privacy Rights" below.

For business transfers: in connection with any merger, sale of Company assets, financing, or acquisition.

With Affiliates: who will be required to honor this Privacy Policy.

With business partners: to offer you certain products, services, or promotions.

With other users: when you share information in public areas.

With your consent: for any other purpose.

We do not sell personal information for monetary consideration. However, our use of advertising cookies and pixels (including the Meta Pixel) to deliver targeted advertising and build advertising audiences may be considered "sharing" of personal information for cross-context behavioral advertising under California law.

In the past twelve (12) months, we have shared the following categories of personal information for cross-context behavioral advertising: identifiers, internet or network activity, and inferences.

We do not knowingly sell or share the personal information of consumers under the age of 16.

How to Exercise Your Rights

To exercise your right to opt out of sale or sharing, you may:

  • Configure your browser to send a Global Privacy Control (GPC) signal, which we honor as a valid opt-out request

We will verify your identity before processing your request, typically by matching information you provide against information in our records. You may designate an authorized agent to make a request on your behalf, subject to verification.

We will respond to verifiable requests within 45 days, with a possible 45-day extension where reasonably necessary.

Your European Privacy Rights (GDPR / UK GDPR)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the following rights under the General Data Protection Regulation ("GDPR") and equivalent laws:

Cookies and the Meta Pixel: For users in the EEA, UK, and Switzerland, advertising and analytics cookies (including the Meta Pixel) will not be set without your prior consent.

International transfers: Your personal data may be transferred to and processed in the United States and other countries where data protection laws may differ. Where required, we rely on Standard Contractual Clauses approved by the European Commission and other appropriate safeguards.

Do Not Track and Global Privacy Control

Some browsers offer "Do Not Track" ("DNT") signals or Global Privacy Control ("GPC") signals. We honor GPC signals from California residents as a valid opt-out of sale and sharing under the CCPA/CPRA. Because there is no industry-standard interpretation of DNT signals, we do not currently respond to DNT signals other than as described above.

Children's Privacy

Our Service is not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. Retention of Your Personal Data

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. Specifically:

  • Account information: for the duration of your account plus up to 7 years after closure for tax, audit, and legal compliance purposes
  • Photos, videos, and project content: for the duration of your account, unless you delete them earlier
  • Usage Data and analytics: typically up to 26 months
  • Advertising and Pixel data: typically up to 180 days, or as set by the advertising platform
  • Marketing communications data: until you opt out, plus a reasonable suppression period
  • Legal compliance records: as required by applicable law

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices in the United States and any other places where the parties involved in processing are located. By using the Service, you consent to the transfer of your information to the United States, where data protection laws may differ from those in your jurisdiction. The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

Delete Your Personal Data
